Then my union sent an email outlining their concerns and a link to their submission. ACMA is an independent Commonwealth statutory authority whose expertise in discerning what comprises \u201cmisinformation\u201d and \u201cdisinformation\u201d is (somewhat boldly) being questioned in the MEAA&#8217;s submission. It says that in combatting misinformation and disinformation, it is important to achieve a balance between protecting the public from serious harm from misinformation and disinformation and ensuring fundamental rights and freedoms are protected. - MEAA\" href=\"https:\/\/www.meaa.org\/mediaroom\/meaa-submission-on-misinformation-and-disinformation\/\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #800000; font-family: arial, helvetica, sans-serif; font-size: 16px;\">MEAA submission on misinformation and disinformation<\/span><\/a><\/p>\n<p>&nbsp;<\/p>\n<h1><strong><span style=\"font-family: arial, helvetica, sans-serif; color: #800000;\"><br \/>\nExtracts from MEAA submission<\/span><\/strong><\/h1>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #000000; font-size: 20px;\">In combatting misinformation and disinformation, it is important to achieve a balance between protecting the public from serious harm from misinformation and disinformation and ensuring fundamental rights and freedoms are protected.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #000000; font-size: 20px;\">ACMA\u2019s proposed powers would enable it to:<\/span><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif; color: #000000; font-size: 20px;\">\u2022 gather information from, or require digital platform providers to keep certain records<\/span><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif; color: #000000; font-size: 20px;\">about matters regarding misinformation and disinformation;<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #000000; font-size: 20px;\">\u2022 request industry develop a code of practice covering measures to combat<\/span><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif; color: #000000; font-size: 20px;\">misinformation and disinformation on digital platforms, which ACMA could register<\/span><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif; color: #000000; font-size: 20px;\">and enforce; and<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #000000; font-size: 20px;\">\u2022 create and enforce an industry standard (a stronger form of regulation), should a<\/span><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif; color: #000000; font-size: 20px;\">code of practice be deemed ineffective in combatting misinformation and<\/span><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif; color: #000000; font-size: 20px;\">disinformation on digital platforms.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #000000; font-size: 20px;\">It is unclear to us whether ACMA has, or will have, the resources and expertise to determine<\/span><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif; color: #000000; font-size: 20px;\">what constitutes \u201cmisinformation\u201d and what does not.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><span style=\"color: #800000;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">Serious Harm<\/span><\/strong><\/span><\/h2>\n<p><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">The proposed powers will only apply to misinformation and disinformation that is <\/span><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">reasonably likely to cause or contribute to \u201cserious harm.\u201d<\/span><br \/>\n<span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">The types of harm are captured by the legislation, including harm to the health of <\/span><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">Australians, and hatred against a group based on ethnicity, nationality, race, gender and the <\/span><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">like.<\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">While many of the harms listed under Schedule 1, section 2 (\u201charm\u201d) are vague and overly <\/span><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">broad (e.g. subclause (e) &#8211; \u201charm to the Australian environment\u201d), subclause \u201c(b) disruption <\/span><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">of public order or society in Australia\u201d is particularly concerning.<\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">MEAA believes the inclusion of this \u201charm\u201d is dangerous and open to misuse and <\/span><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">exploitation. Indeed, there is a long history of important social movements being considered <\/span><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">\u201cdisruptive\u201d by governments and powerful interests.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><strong><span style=\"font-family: arial, helvetica, sans-serif; font-size: 24px; color: #800000;\">Scope<\/span><br \/>\n<\/strong><\/h2>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">The scope of the proposed legislation is wide, only excluding content produced in good faith <\/span><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">for the purposes of entertainment, satire or parody, and professional news content as well <\/span><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">as content produced by or authorised by, respectively, educational institutions and <\/span><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">governments.<br \/>\n<\/span><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">While professional news content is excluded, it is essential in maintaining and renewing <\/span><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">trust in the media that news organisations be transparent about their stances on issues, and <\/span><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">ensure their own ethical codes and complaints procedures (including how they deal with <\/span><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">misinformation\/disinformation) are easily accessible to consumers.<br \/>\n<\/span><br \/>\n<span style=\"font-size: 20px; color: #000000; font-family: arial, helvetica, sans-serif;\">MEAA suggests that the proposed definition \u201cprofessional news content\u201d in the Bill be amended to specifically refer to adherence to MEAA\u2019s Journalist Code of Ethics.<\/span><\/p>\n<p><span style=\"font-size: 20px; color: #000000; font-family: arial, helvetica, sans-serif;\">MEAA believes the exclusion of content produced by federal, state, territory or local governments is concerning. It is simply unreasonable that the view of governments be protected from the reach of this Bill\u2019s definition of \u201cmisinformation\u201d and paves the way for government to politicise valid criticisms of it while engaging in misinformation of its own.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">It is also unclear why the code and standard-making powers will not apply to authorised electoral and referendum content.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">Disinformation and misinformation in these forms of information has the capacity to contribute to the undermining of our democratic institutions. By way of a current example, \u201cYes\u201d and \u201cNo\u201d vote documents are being distributed to voters by the AEC as part of the Voice to Parliament referendum process without any independent fact-checking. It\u2019s almost certain those documents will be posted on digital platforms, but the creators (politicians and bureaucrats) would be exempt from the provisions of the proposed law.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><strong><span style=\"font-family: arial, helvetica, sans-serif; color: #800000;\">Conclusion<\/span><\/strong><\/h2>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">MEAA believes the Australian Government has a responsibility to combat the very real problem of misinformation and disinformation. It is essential that digital platforms be accountable for the often deliberately misleading or fabricated information online.
