But it is not giving up the fight against the mining corporation\u2019s sham Indigenous land use agreement (ILUA).<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px;\"><span style=\"color: #000000;\">The WJFC<\/span> <a href=\"https:\/\/web.archive.org\/web\/20240323193718\/https:\/\/wanganjagalingou.com.au\/federal-court-adani-decision-%ef%bb%bfwjs-rights-fight-will-continue\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #800000;\">said<\/span><\/a> <span style=\"color: #000000;\">the Federal Court\u2019s decision to dismiss its appeal against the certification and registration of the Adani ILUA confirms the <em>Native Title Act<\/em>\u2019s \u201cnear enough is good enough\u201d approach.<\/span><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">It is considering its legal options while continuing to build pressure on the Queensland government to stop Adani going ahead with its proposed Carmichael coalmine in Central Queensland.&nbsp;<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">WJFC senior spokesperson Adrian Burragubba noted the irony of the court decision being released on NAIDOC day. \u201cThis is a day to remember. On \u2018black fella day\u2019 the Full Bench of the Federal Court denied us our right to stand up and say \u2018that\u2019s our land and we\u2019re not going to give it away\u2019.&nbsp;<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">\u201cWe don\u2019t intend to give up. We will build public pressure on the Queensland government to accept their part in dividing our people and ignoring our rights.\u201d<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">The WJFC noted the decision hinged only on the question of whether the certification and registration of the Adani ILUA were handled according to the legal requirements of the <em>Native Title Act<\/em>.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">The ruling did not comment on the contested dealings leading up to, and after, the Adani-organised meeting more than three years ago.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">The WJFC said there are no grounds to conclude from this decision that those attending the Adani meeting were entitled, under the laws and customs of Wangan and Jagalingou people, to sign away their rights in land for monetary compensation.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">\u201cA lot of our people were played into position by the government and Adani, and stitched up by a legal process they have no control over\u201d, Burragubba said.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">WJFC spokesperson Murrawah Johnson said that they would continue to \u201cpursue all legal and political avenues in opposition to the coal mine and the destruction of Wangan and Jagalingou Country\u201d.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">\u201cWith Adani commencing initial works, our focus will shift to exposing the failure of the state government in issuing the mining leases without an ILUA and without consent.\u201d<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">She said the decision does not \u201cretrospectively validate\u201d the Queensland government\u2019s \u201cabysmal conduct in backing Adani and stepping on our rights\u201d.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">Johnson added that the council would challenge the environmental approvals \u201cgiven without regard to First Nations cultural rights in our land and waters, and the plants and animals that depend upon them\u201d.&nbsp;<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">\u201cWe know we have always had a fight on our hands\u201d, Johnson said, adding that the fight is not just with Adani, but with the federal and Queensland governments.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">\u201cIt is shameful that the state delivered mining leases to Adani without an ILUA or our consent, and twice the federal government intervened in our cases to ensure Adani\u2019s interests, including in this most recent appeal.\u201d<\/span><\/p>\n<p>&nbsp;<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"field field-name-field-glw-author-term field-type-taxonomy-term-reference field-label-hidden\">\n<div class=\"field-items\">\n<div class=\"field-item even\"><span style=\"font-size: 16px; font-family: arial, helvetica, sans-serif;\"><a href=\"https:\/\/www.greenleft.org.au\/glw-authors\/margaret-gleeson\"><span style=\"color: #800000;\">Margaret Gleeson<\/span><\/a><\/span><\/div>\n<\/div>\n<\/div>\n<div class=\"field field-name-field-publication-date field-type-datetime field-label-hidden\">\n<div class=\"field-items\">\n<div class=\"field-item even\"><span class=\"date-display-single\" style=\"color: #000000; font-family: arial, helvetica, sans-serif; font-size: 16px;\">July 19, 2019<\/span><\/div>\n<\/div>\n<\/div>\n<div>&nbsp;<\/div>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp; &nbsp; &nbsp; The Wangan and Jagalingou Family Council (WJFC) lost its Federal Court challenge against Adani on July 12, NAIDOC day.
